Authenticity & Intellectual-Property Compliance Policy

1. Purpose and Scope

This policy explains how StrengthXPhysio ensures that every product offered on www.strengthxphysio.com is authentic, legally sourced, accurately represented, and fully compliant with Google Merchant Center, Google Ads, and broader e-commerce regulations. The policy applies to all product categories we stock—currently including smartwatches and wearables, body-composition scales, EMS recovery gear, Pilates and yoga equipment, and future assortments introduced under the StrengthXPhysio brand.

2. Legal Foundation

  1. Counterfeit & Misrepresentation Laws – We observe the World Intellectual Property Organization (WIPO) conventions, the EU Trademark Regulation, U.S. Lanham Act, Swiss Trademark Act, and analogous statutes wherever we sell or ship.
  2. Google Policies – We comply with Google’s Counterfeit Goods, Misrepresentation, and Shopping Ads policies. That means:
    • No fake or replica items
    • No unauthorised use of third-party brand names, logos, or imagery
    • Complete, truthful product data in every feed attribute (title, description, GTIN, MPN, condition, availability, price, variant attributes, and unique identifiers)
  3. Data & Privacy Law – Supplier and customer data are handled under Swiss Federal Act on Data Protection (FADP) and GDPR standards.

4. Product Integrity Assurance

  • Security Seals & Serialisation – High-value electronics carry tamper-evident seals and unique serial numbers traceable to the production lot.
  • Packaging Guidelines – Plain-label packaging unless an original design is expressly licensed; no unlicensed third-party marks appear anywhere on the box or inserts.
  • Warranty & Service – Each electronic device ships with a minimum 12-month warranty, fulfilled in-house or by authorised service partners.

5. Accurate Representation in Marketing & Feeds

  • Titles & Descriptions – Focus on functional attributes (size, material, key features). Brand names are used only if the supplier is officially licensed to do so.
  • Imagery – Studio photos shot on neutral backgrounds; no competitor logos; no edited trademarks.
  • Pricing & Promotions – Discounts are calculated from verifiable list prices and must be available for at least 30 days before comparison claims are made, per Swiss price-indication rules and Google’s Sale Price policy.
  • Landing Pages – Each product page displays the same currency, price, availability, shipping cost, and variant options that appear in our Google product feed.

6. Customer Protection

  • 90-Day Money-Back Guarantee – If a buyer has any doubt about a product’s authenticity or description accuracy, we refund or replace immediately.
  • Dispute Escalation – Unresolved issues may be escalated via PayPal Buyer Protection, the customer’s card issuer, or the Swiss Online Dispute Resolution (ODR) platform.

7. Rights-Holder Notice & Takedown Procedure

  1. Submit a Complaint – Email support@strengthxphysio.com with the URL or SKU, documentary proof of your intellectual property right, and evidence of alleged infringement.
  2. Immediate Review – Our compliance team acknowledges receipt within 24 hours and temporarily removes the listing from public view while we investigate.
  3. Assessment Window – We examine purchase records, supplier IP declarations, and compliance documents. If infringement is confirmed, the product is permanently delisted and remaining stock is disposed of or returned.
  4. Written Outcome – Both the complainant and supplier receive a written decision within 48 hours.
  5. Appeals – Suppliers may provide additional evidence; if the appeal fails, the vendor contract is terminated.

8. Continuous Improvement & Auditing

  • Quarterly Internal Audits – Policy, supplier list, product catalogue, and Google Merchant Center diagnostics are reviewed every three months.
  • Annual External Audit – An independent compliance consultancy assesses our IP-protection programme and issues a written attestation.
  • Policy Updates – Material changes to this document are time-stamped and archived; customers and suppliers are notified via email newsletter.
